User Registration

Profile creation is an essential feature of our platform, allowing Service Providers and independent contractors to create comprehensive profiles that showcase their skills, services, and experience to potential clients. Our platform's profile creation feature enables service providers to present themselves in the best possible light, providing a convenient way for them to market their services to a broader audience.
When creating their profiles, service providers and independent contractors can provide various details such as their skills, services offered, pricing, availability, images, videos, and reviews from previous clients. They can also customize their profiles according to their preferences, ensuring that their profiles align with their brand and image.
The profile creation feature of our platform ensures that service providers and independent contractors can provide potential clients with a detailed overview of their services, ensuring that they are better equipped to make informed decisions when choosing a service provider. With this feature, service providers can increase their visibility and reach a broader audience, leading to increased business opportunities and improved client satisfaction.

Booking and Scheduling

Our application allows users to search for service providers or independent contractors based on location, services, availability, and ratings. Once a user has selected a service provider or independent contractor, they can book appointments, schedule services, and communicate with service providers through in-app messaging or chat features.
Users can view a service provider's or independent contractor's calendar to check availability and select a suitable time for the service. They can also select the specific services they require and pay for them securely within the application.
Users can receive notifications and reminders for upcoming appointments, and they can cancel or reschedule bookings if necessary. The application provides real-time updates on the status of the service, such as when the service provider or independent contractor is on their way and when they have arrived.
The application also allows users to provide feedback and ratings for service providers or independent contractors after the service is complete, which helps build trust among users and supports quality control efforts.

Live Map:

Our platform includes an interactive live map that displays the real-time location of service providers and independent contractors who are available for services. This feature makes it easy for users to locate nearby service providers and contractors and select the one that best suits their needs.
The live map also provides users with the ability to filter service providers based on their location, services, availability, and ratings. This allows users to select the service provider that best fits their preferences and schedule.
Moreover, the live map feature integrates with the booking and scheduling system to enable users to book appointments and schedule services with their preferred service providers directly from the map interface. This feature adds convenience and efficiency to the user experience and encourages users to make use of the platform for their beauty and wellness needs.
We understand the importance of privacy and security, and thus, we have implemented strict privacy protocols for the live map feature. Users can choose to hide their location on the map, and service providers' exact location is only visible to users who have booked their services. Our platform ensures that user data and information are secure and protected.

Affiliates Marketing and Referral

Eligibility: To participate in the referral program, users must be registered and have an active account on the application. Referral rewards are only available to users who have referred the application to others, and the referrals must have completed their first transaction on the application.

Once a service provider or independent contractor completes a service or receives a payment, the app updates their earnings automatically, which can be viewed on their dashboard. They can also track their spending by viewing payment transactions, including payment gateway charges, refunds, and other fees.
In addition, the app also allows service providers and independent contractors to track tips they receive through the app. They can view their tips on their earnings page and include them in their overall earnings.
This feature ensures that service providers and independent contractors have a transparent view of their financials, allowing them to make informed business decisions. The feature also helps build trust and transparency between the service providers and the platform, which is essential for maintaining long-term relationships.

Payment Integration

Ratings and Reviews:

The application allows users to rate service providers based on a scale of one to five stars, with five being the highest rating. Additionally, users can provide a detailed review of their experience, including feedback on the quality of the service, professionalism, and overall satisfaction. Service providers have the ability to view their ratings and reviews, which can be used to improve their services and address any concerns raised by users. The application has a policy against fake reviews and ratings, and any attempt to manipulate or misuse the rating and review system will result in account suspension or termination. By using the application, users agree to the terms and conditions governing the rating and review system and acknowledge that their feedback may be shared with other users.

Reporting and Monitoring

To ensure compliance and quality control, the application will implement live reporting and monitoring features for administrators. This feature will allow administrators to track all activities within the application, including user activities, payments, bookings, and reviews.
The reporting and monitoring feature will provide insights into application usage and help administrators detect any potential issues or fraudulent activities. The feature will also allow administrators to monitor the performance of service providers and independent contractors, ensuring that they adhere to the terms and conditions of the application.
The live reporting feature will include detailed reports on various metrics, such as user demographics, service utilization, payment history, and reviews. Administrators can use these reports to make data-driven decisions to improve the user experience and application performance.
In addition, the application will incorporate a flagging system that allows users to report any suspicious activities, inappropriate behavior, or fraudulent service providers. The system will send an alert to the administrator, who will investigate the report and take appropriate actions if necessary. The application will also implement a data protection and privacy policy to protect user data and comply with data protection regulations. The privacy policy will outline the types of data collected, how it is stored, and how it is used. The application will also use secure data storage and encryption to ensure the confidentiality of user data.

Intellectual Property Rights

All intellectual property rights, including but not limited to patents, trademarks, copyrights, trade secrets, and any other proprietary information related to the Application, are and will remain the sole property of Linkync or its licensors. You acknowledge that you have no ownership or proprietary interest in the Application or its intellectual property, and agree not to use or exploit any of the intellectual property without the prior written consent of Linkync.

User Consent

By using the Application, you grant Linkync a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display any content or materials you submit to or through the Application, including but not limited to text, images, videos, and reviews. You represent and warrant that you have all necessary rights to grant such license and that any such content or materials do not infringe upon the intellectual property rights of any third party.

Prohibited Use

You agree not to use the Application in any way that infringes upon the intellectual property rights of Linkync or any third party. You further agree not to reverse engineer, decompile, or disassemble any part of the Application or attempt to derive the source code, underlying ideas, or algorithms of the Application. Any unauthorized use or exploitation of the intellectual property of Linkync or any third party may result in legal action.

Reporting Intellectual Property Infringement

If you believe that your intellectual property rights have been infringed upon by a user of the Application, please contact Linkync immediately. Linkync will investigate and take appropriate action, including removing any infringing content, terminating the accounts of repeat infringers, and pursuing legal action if necessary.
By using the Application, you acknowledge and agree to the above terms and conditions regarding intellectual property.

Termination

Termination by User: Users have the right to terminate their agreement with the service provider at any time by providing written notice to the service provider. Upon termination, the user's account will be deactivated, and they will no longer have access to the platform.
Termination by Service Provider: The service provider reserves the right to terminate the user's access to the platform, in whole or in part, for any reason or no reason at all, including but not limited to breach of the terms and conditions or violation of applicable laws. The service provider will provide written notice to the user of the termination, along with the reason for such termination.
Effect of Termination: Upon termination of the user's agreement with the service provider, the user must immediately cease all use of the platform and return or destroy any confidential information, intellectual property, or proprietary data provided by the service provider. The service provider is not responsible for any loss or damage suffered by the user as a result of the termination.
Refunds: In the event of termination by the user, the service provider will not be responsible for any refunds, unless otherwise agreed upon in writing. In the event of termination by the service provider, the service provider may provide a pro-rated refund to the user for any prepaid fees.
Survival: The termination of the user's agreement with the service provider shall not affect any provisions that, by their nature, are intended to survive termination, including but not limited to intellectual property rights, confidentiality obligations, and liability limitations.
Dispute Resolution: In the event of a dispute arising out of or related to the termination of the agreement, the parties agree to resolve such dispute through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be held in the city where the service provider is located.

Data Privacy

The service provider shall comply with all applicable data privacy laws and regulations, including but not limited to the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA). The service provider shall collect, use, store, and process personal information only for the purpose of providing the services offered on the platform. The service provider shall obtain explicit consent from the user before collecting any personal information.
The service provider shall implement appropriate technical and organizational measures to protect the personal information of the users from unauthorized access, use, or disclosure.
The service provider shall not share or disclose personal information of the users to any third party except as required by law or as necessary to provide the services offered on the platform.
The service provider shall provide users with the ability to access, correct, or delete their personal information collected by the service provider. Users may also request the service provider to restrict the processing of their personal information or object to the processing of their personal information.
The service provider shall notify users of any breach of their personal information within the timeframe required by applicable data privacy laws and regulations.
The service provider shall provide users with a clear and concise privacy policy that outlines the types of personal information collected, how it is used, stored, and processed, and the rights of users regarding their personal information.
The service provider shall obtain explicit consent from the user before collecting any sensitive personal information, such as health information or financial information.
The service provider shall regularly review and update its data privacy policies and procedures to ensure compliance with applicable data privacy laws and regulations.
Users who have concerns regarding their personal information collected by the service provider may contact the service provider's data protection officer (DPO) or a designated representative for further assistance.
By agreeing to the terms and conditions, users acknowledge that they have read and understood the service provider's data privacy policy and consent to the collection, use, storage, and processing of their personal information as outlined in the policy.

Warranties and limitations of liability

Service Provider warrants that the software will perform substantially in accordance with the specifications set forth in the user documentation.
Service Provider does not warrant that the software will be error-free, uninterrupted, or completely secure.
Service Provider shall not be liable for any damages arising out of the use or inability to use the software or the service, including but not limited to direct, indirect, incidental, or consequential damages.
Service Provider's liability under this agreement shall be limited to the fees paid by the user for the service.
The user agrees to indemnify and hold Service Provider harmless from any claims, damages, or expenses arising from the user's use of the software or the service.
The user acknowledges that the service may be subject to limitations, delays, and other problems inherent in the use of the internet and electronic communications, and the Service Provider shall not be responsible for any delays, delivery failures, or other damage resulting from such problems.
The user acknowledges that the service may be suspended or terminated at any time, with or without notice, and the Service Provider shall not be liable to the user or any third party for any damages resulting from such suspension or termination.
The user acknowledges that the software and the service are provided "as is" and without any warranties or representations of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
The user agrees that any dispute arising out of this agreement shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
By agreeing to these terms, the user acknowledges and agrees to the warranties and limitations of liability set forth in this agreement.

Force Majeure

Force Majeure: Neither party shall be liable for any failure to perform its obligations under this agreement if such failure is caused by events beyond its reasonable control, including, but not limited to, acts of God, war, riots, terrorism, fire, flood, natural disaster, or governmental regulations, provided that the affected party promptly notifies the other party of the force majeure event and uses its best efforts to resume performance as soon as possible. If the force majeure event continues for more than 30 days, either party may terminate this agreement without liability to the other party Third-Party Services.
Third-Party Services: The Service may include links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such third-party websites or services. We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.
In using the Service, you may also elect to use third-party services that integrate with the Service. Your use of such third-party services is solely between you and the applicable third-party service provider. We do not endorse, warrant, or guarantee any such third-party services, and will have no liability or responsibility for your use of or reliance on any such third-party services.
We may also provide tools and resources that allow you to interface with third-party services or data sources. We do not guarantee the accuracy, completeness, or reliability of any such third-party data, and shall not be liable for any damage or loss arising from your use of or reliance on any such third-party data. You are solely responsible for ensuring that any third-party data accessed or processed through the Service is compliant with all applicable laws and regulations.

User Conduct:

The SAAS platform expects users to conduct themselves in a responsible, ethical, and legal manner. Users must refrain from using the platform for any purpose that is illegal, harmful, or in violation of the terms and conditions. The following is a list of prohibited activities:
Using the platform for any illegal or unauthorized purpose. Posting or transmitting any material that is illegal, obscene, defamatory, or offensive.
Interfering with the security or functionality of the platform, including attempts to access unauthorized areas of the platform.
Uploading or transmitting any viruses, malware, or other harmful code.
Engaging in any activity that could damage, disable, overburden, or impair the platform or any other user's experience.
Attempting to access or obtain the account information of any other user.
Engaging in any activity that violates any local, state, or federal laws or regulations.
The SAAS platform reserves the right to investigate any violations of these policies and take appropriate action, including terminating user accounts or reporting illegal activity to the proper authorities. Users who violate these policies may also be held liable for any damages caused by their actions.
